1. Scope
These Terms and Conditions (T&C) apply to the use of the online platform tathood, accessible at https://www.tathood.com (hereinafter "Platform").

The platform is aimed at: • Tattoo Artists and Tattoo Studios (hereinafter "Artists") • Users who want to discover or contact Tattoo Artists (hereinafter "Users")
2. Subject Matter
tathood is a digital platform for the presentation, inspiration and curated display of tattoo art as well as for establishing contact between users and artists.
tathood is not a tattoo studio and is not a contractual partner for tattoo services.
Contracts for tattoos, prices, appointments or services are concluded exclusively between users and artists.
3. Registration and User Account
3.1 Registration
For certain functions of the platform, in particular for artist profiles, uploads, favorites or messages, the creation of a user account is required.
The information provided during registration must be truthful, complete and current.
3.2 Access Data
Users are obliged to keep their access data secret and to report any misuse immediately.
tathood is not liable for damages resulting from unauthorized use of a user account.
4. Content from Artists and Users
Artists and users can post content on the platform, in particular images, videos, texts, descriptions and profile information.
The uploading user warrants that they have all necessary rights to the uploaded content and that the content does not infringe any third-party rights.
5. Usage Rights to Content
5.1 Grant of Rights
By uploading content, the user or artist grants tathood a simple, unlimited in time and space, transferable and sublicensable right to use the content:
- to display on the platform
- to process, store and reproduce technically
- to use for marketing and advertising purposes of tathood
- to publish on social media platforms (in particular Instagram, Pinterest, TikTok, Facebook, X and LinkedIn)
- to curate editorially (e.g. collections, recommendations, highlights)
- to use in the context of press, PR and cooperation measures
The use is in particular to increase the visibility and reach of artists and their work.
5.2 No Exclusivity
The grant of rights is not exclusive. Artists retain the right to use their content themselves at any time.
6. Personality Rights and Consents
The user or artist warrants that:
- the person depicted or tattooed has consented to the publication of the content
- this consent also includes the use by tathood for marketing and social media purposes
- the consent was obtained effectively, voluntarily and legally
The user indemnifies tathood from all claims of third parties resulting from the violation of personality, copyright or data protection rights.
7. Moderation and Removal of Content
tathood reserves the right to review, curate, highlight, restrict or remove content at its own discretion.
There is no claim to publication, highlighting or reach.
Already published content may continue to be used for archival, documentation or marketing reasons, unless there are overriding legitimate interests of the user.
8. Prohibited Content
It is prohibited to post content that is illegal, offensive, discriminatory, pornographic, harmful to minors, misleading or unrelated to the purpose.
9. Liability
tathood is not liable for content from users or artists, nor for the quality, execution or results of tattoo services.
The liability of tathood is excluded – to the extent legally permissible.

The processing of personal data is carried out in accordance with the privacy policy, available at:
11. Termination and Deletion
Users can delete their user account at any time or request deletion.
tathood is entitled to block or delete user accounts in case of violations of these T&C.
12. Changes to the T&C
tathood reserves the right to change these T&C if there are objective reasons, in particular legal or functional changes to the platform.
Continued use of the platform is considered consent to the amended T&C.
13. Final Provisions
The law of the Federal Republic of Germany applies.
If a provision of these T&C is wholly or partially invalid, the validity of the remaining provisions remains unaffected.
